Conditions MyCommunityDefib Support Package
The owner of the defib that has been delivered a defibrillator package via MyCommunityDefib platform, hereinafter referred to as the Client, and AED360 Limited (operated by Baywater Healthcare Ltd. (Wulvern House, Electra Way, Crewe, Cheshire, CW1 6GW), hereinafter referred to as the Contractor, declare to have concluded a Support Agreement in accordance with the following provisions:
Support package ‘MyCommunityDefib’
- Helpline and email contact seven days a week from 8.00am to 8.00pm for queries and support and after use or malfunction of your defib.
- In the event of malfunction of your defib, you are entitled to a Philips manufacturer's warranty for up to 8 years after purchase.
- If necessary, provision of a temporary replacement defib, so that you are never without
- Replacement HS1 defib in case of theft and vandalism*
- Automatic delivery of new electrodes/pads after 2 years
- Delivery of new pads after use of the defib, provided that it has been demonstrably deployed.
- The defib is included in our database.
Special conditions support package ‘MyCommunityDefib’
The Client becomes the owner of the defib and outdoor cabinet and must continue to meet the following conditions during the term of this support package to retain the right to the MyCommunityDefib Support package:
- The defib with outdoor cabinet is mounted in a public place that is available 24 hours a day.
- The outdoor cabinet is connected to a working power supply due to lighting and heating capability.
- The defib is registered with the Circuit. This indicates that the defib is always available.
Maintenance
- The Contractor is obliged to perform the service activities as described under the MyCommunityDefib Support Package during the contract period.
- The Contractor has included the Client's Defib in its database. The Contractor will deliver the materials to the Client before the due date.
- The client is responsible for placing the materials in the Defib using the clear instructions provided on receipt of the defib.
Malfunction or use of the Defib
- If the Defib has been deployed demonstrably, new electrodes/pads will be sent after notification to the Contractor: info@mycommunitydefib.co.uk or 01270 – 696 367.
- If a defib shows a malfunction or has been used, the Client must contact the Contractor as soon as possible. On notification, the Contractor will decide whether a replacement AED will be made available to the Client for the duration of the resolution.
- If the malfunction appears to have been caused by the Client itself, the costs for repair (or replacement) and labour (including logistic expenses) may be charged. In this case e.g. this includes impact, fall, breakage, liquid and water damage and damage caused by improper use. The assessment of this is carried out by competent employees of the Contractor.
- Within the MyCommunityDefib Support Package, only additional consumables (if applicable) are charged separately. Additional consumables may include:
- The Contractor can determine the fault and usage history of the defib by retrieving data from the defib.
- For the calculation of the costs, the prices of the Contractor will be used.
Coverage of the Service Agreement
- The terms of this Agreement apply only to Philips HS1 AEDs.
Duty of care of Client
- Because the Client makes this defib available to the community (the neighborhood) of the Client, the MyCommunityDefib Support Package has been put together. This obliges the Client to always make and keep the defib available to the neighborhood, as described under heading “Special conditions MyCommunityDefib’.
- If the Client has obtained the defib through fundraising in the neighborhood (for example via MyCommunityDefib.co.uk, the Client is aware that the defib was made possible in part by the neighborhood, even if the Client has acquired ownership. In this case, the Client will take care of the defib with due care and declares that it will never remove both the defib and its availability from the original neighborhood.
Service Agreement Effective Date
- The effective date of this Service Agreement is the date the defib is delivered to the specified address.
Duration, Renewal and Termination of the Agreement
- The contract period ends 4 years after delivery of the defib.
- In the year prior to the termination of this agreement, the Contractor will inform the Client about ongoing maintenance options after termination of the initial support package.
Payment
- Billing for additional consumables is by invoice. The payment term of the invoice is 14 days after the invoice date to the Contractor.
Other conditions
- The client hereby also accepts the Terms and Conditions of MyCommunityDefib. The Client has viewed and accepted these Conditions during the creation of its crowdfunding campaign on mycommunitydefib.co.uk.
- Changes to, or transfer of this Support Package to a third party by the Client are only possible with the prior written permission of the Contractor.
